Terms of Service

1. Introduction

Welcome to the 4Square Loyalty Points Program. These Terms of Service ("Terms") govern your access to and use of our loyalty points platform, including the purchase, accumulation, and redemption of loyalty points. By using our services, you agree to comply with these Terms. If you do not agree, you may not use our services.

2. Eligibility

  • You must be at least 21 years old or the age of majority in your jurisdiction to participate.
  • Your account must be in good standing and comply with all applicable laws and regulations.
  • We reserve the right to refuse service or terminate accounts that violate these Terms.

3. Account Registration & Security

  • You are responsible for maintaining the confidentiality of your account credentials.
  • Any activity under your account is your responsibility.
  • If you suspect unauthorized access, you must notify us immediately.

4. Purchasing & Redeeming Points

  • Loyalty points may be purchased using approved payment methods.
  • Points have no cash value and cannot be exchanged for money or transferred to another account.
  • Points can only be redeemed with participating merchants within the program.
  • We may adjust your points balance due to system errors, suspected fraud, or policy violations.

5. Refund & Chargeback Policy

  • Refunds for unused points are governed by our Refund Policy.
  • Chargebacks or unauthorized payment disputes may result in account suspension or termination.
  • Refund requests must be submitted through our designated process and are subject to compliance review.
  • Chargebacks must be disputed within 60 days of the original transaction.
  • Disputed chargebacks may require supporting documentation, and failure to provide requested information may result in account restrictions.

6. Fraud Prevention & Compliance

  • Any fraudulent activity, including attempting to manipulate points accumulation or refunds, may result in account suspension, blacklisting, and legal action.
  • We comply with all AML (Anti-Money Laundering) and KYC (Know Your Customer) regulations to prevent unauthorized transactions.
  • Fraud Detection Measures:
    • Transaction monitoring and velocity checks to identify unusual activity.
    • Multi-factor authentication (MFA) for high-risk transactions to prevent unauthorized access.
    • Account activity scoring to flag potential fraudulent behavior.
    • Automated alerts for suspicious refund or redemption patterns.

7. Account Suspension & Termination

  • We reserve the right to suspend or terminate accounts involved in fraud, abuse, or violations of these Terms.
  • Termination may result in the forfeiture of any unused points.
  • Users may appeal account suspensions through our compliance review process.
  • Accounts may be suspended without prior notice in cases of suspected fraud, chargeback abuse, or compliance violations.
  • In cases where immediate suspension is not required, users will receive prior notice and have 7 days to respond before termination.

8. Limitation of Liability

  • We are not responsible for losses due to unauthorized access, third-party fraud, or system malfunctions.
  • The Loyalty Points Program is provided "as is," without warranties of any kind.
  • Our liability is limited to the amount paid for unredeemed loyalty points.

9. Hold Harmless Clause

  • You agree to indemnify, defend, and hold harmless 4Square Systems Inc., its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with:
    • Your use of the Loyalty Points Program.
    • Any violation of these Terms by you or any other person using your account.
    • Any third-party claim related to your misuse of the services.
  • This hold harmless clause applies to the maximum extent permitted by law, regardless of the form of action, whether in contract, tort, or otherwise.

10. Modifications to the Terms

  • We reserve the right to modify these Terms at any time.
  • Users will be notified of significant changes, and continued use of the service constitutes acceptance of the updated Terms.

11. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Delaware.
  • Disputes will be resolved through binding arbitration in accordance with the laws of Delaware.
